Court of Cassation ruling of March 12, 2025: this decision strengthens the scope of testing by limiting certain technical challenges regarding the test model, its expiration date, or its conditions of use when the procedure complies with the applicable framework.
CBD, THC and driving: why the risk always exists
CBD is not THC. However, some CBD products may contain traces of THC. In terms of driving, detectable THC presence can cause problems, even when the driver claims to have consumed a product presented as legal.
The Court of Cassation’s case law has already reminded that the thresholds set by the decree of December 13, 2016, do not necessarily distinguish illicit cannabis use from the use of a CBD product containing THC. For the driver, this creates a very real risk during a check.

Bonjour ce weekend j’ai eu un contrôle pour le Stup alors que je n’avais rien consommé le test était positif le contrôle a mis au moins une heure et demie avant de pouvoir avoir les traits ou pas sur le test ça a mis au moins 30 minutes et ils l’ont mis sur le chauffage pour soi-disant que le produit agisse mieux est-il possible que le test soit positif à cause de la chaleur ou d’avoir attendu
