Saliva testing in Belgium: screening, analysis, and consequences

In Belgium, the roadside saliva test is a screening step, not a miniature laboratory analysis. When the procedure continues, the sample analyzed according to official rules determines the case outcome.

Why distinguish three steps?

Older presentations sometimes summarized the check as a simple list of signs and thresholds. In reality, it is necessary to distinguish the initial assessment, the rapid test, and the confirmatory analysis.

  1. observation and decision to test: the police assess the elements provided by regulations and the context of the check;
  2. rapid saliva test: the device screens for several drug families;
  3. analyzed sample: in case of a positive result, the official procedure provides for an analysis to confirm and quantify the substances sought.
A self-test purchased online is not interchangeable with the equipment and procedure of the Belgian police. Thresholds, substances, samples, and rules of evidence may differ.

Which substances can be detected?

Checks mainly target cannabis, cocaine, amphetamines, MDMA, and certain opiates. The exact list depends on the device and current regulations.

New cannabinoids, some medications, and other substances are not necessarily covered by a standard test. A negative result therefore does not exclude all causes of impairment.

Why no longer display old thresholds as permanent truths?

Technical and legal thresholds can evolve. They are not always identical between the screening test and the laboratory analysis. A value related to THC cannot be applied to another molecule or another type of sample.

To know the applicable values at the time of the check, consult the Federal Police, SPF Mobility and Transport, or the official Belgian texts.

What are the consequences after a confirmed result?

The driver may be subject to immediate measures regarding their driving rights, followed by judicial proceedings. Fines, driving license suspension, reintegration exams, and other consequences may be added depending on the facts.

Amounts depend on the qualification, the case, a repeat offense, an accident, or combination with alcohol. An old range published in an article should not be considered the automatic sanction for all cases.

Driving after consumption remains dangerous even when the person no longer feels any effect. A legal or technical threshold is not a target to reach before getting back on the road.

A product may have thresholds or substances close to certain devices, but that is not enough to qualify it as legally equivalent. Its instructions, intended use, and the context in which it is used must be examined.

How to use a self-test responsibly?

  • read the substances and thresholds indicated in the instructions;
  • respect the sampling conditions and reading time;
  • consider an invalid or doubtful test as not reassuring;
  • never drive after consumption based solely on a negative result;
  • plan for a sober driver or another transport solution.
