Roadside checks are not limited to a strip read at the roadside. They include screening, analytical verification, and procedural rights that must be distinguished.
In which cases can screening be carried out?
Screening is mandatory after a fatal or bodily injury accident. It can also be carried out after a material accident, a traffic offense, suspicion of consumption, or as part of an operation decided by law enforcement or the public prosecutor.
How does the procedure work?
Saliva screening
The police or gendarmerie usually use a field saliva test. The urine test exists but is less commonly used and must be performed by a doctor.
Verification sampling
If the screening is positive, a saliva sample is taken and then analyzed by a laboratory or an accredited expert.
Reservation of the right to counter-expertise
The driver must be asked if they wish to reserve the right to request a counter-expertise. If the answer is positive, a blood sample is taken during the procedure.
Results and consequences
The analysis results determine the administrative and judicial consequences. Retention or suspension of the license may occur depending on the applicable framework.
What sanctions in 2026?
Main penalty
Up to three years imprisonment and a €9,000 fine for driving after drug use.
License
The conviction automatically results in the reduction by half of the maximum number of points, i.e., six points on a twelve-point license.
Additional penalties
Suspension or cancellation of the license, awareness course, immobilization or confiscation of the vehicle may be imposed depending on the situation.
Alcohol and drugs
Combining with alcohol worsens penalties and possible consequences on the vehicle and license.
CBD and THC saliva test
A CBD product may contain residual THC. Consumption of such a product can therefore result in a positive THC result. The commercial legality of the product does not guarantee protection against road consequences related to the presence of THC.
Self-test and official control: two different uses
A saliva self-test purchased commercially can help make a cautious decision, but it does not replicate the entire official procedure. A negative result neither guarantees the absence of substance nor the absence of risk, and never constitutes a driving authorization.

Bonjour ce weekend j’ai eu un contrôle pour le Stup alors que je n’avais rien consommé le test était positif le contrôle a mis au moins une heure et demie avant de pouvoir avoir les traits ou pas sur le test ça a mis au moins 30 minutes et ils l’ont mis sur le chauffage pour soi-disant que le produit agisse mieux est-il possible que le test soit positif à cause de la chaleur ou d’avoir attendu
