CBD, THC and driving: what the law says in France

To remember. CBD is not the substance targeted by a THC saliva test. The risk mainly comes from the residual presence of THC in some CBD products. A legally marketed product can therefore expose a driver to a positive result.

Legal CBD does not mean absence of THC

In France, certain hemp-derived products can be marketed when they comply with applicable regulations. However, this commercial legality does not guarantee that a product is completely free of THC.

After consumption, traces of delta-9-THC can remain in the oral cavity or be absorbed by the body. They can then be detected during a roadside check, especially after using flowers, resins, or inhaled products containing residual THC.

What does the Highway Code sanction?

The offense concerns driving after using a substance or plant classified as a narcotic, when this use is established by a saliva or blood test. The procedure does not rely on proving that the driver appeared impaired at the time of the check.

Key legal point. The fact that a CBD product can be sold legally does not erase the possible presence of THC detected in the body. The authorized concentration in the commercial product and the rule applicable to the driver are two different issues.

Does CBD itself cause a positive THC test?

A properly designed test targets THC or a marker defined by its instructions, not CBD itself. A positive result after consuming a CBD product can be explained by actual THC presence, product contamination, or, depending on the device, a cross-reaction documented by the manufacturer.

It is therefore incorrect to claim that all CBD products systematically result in a positive test. It is equally incorrect to guarantee that a CBD product will never be detected.

What penalties are incurred?

In 2026, driving after drug use is punishable by up to three years imprisonment and a €9,000 fine, with a six-point deduction. Additional penalties may apply, including suspension or cancellation of the license and immobilization or confiscation of the vehicle.

How long to wait before driving?

There is no universal delay guaranteeing a negative test. Detection depends on the product, its actual THC content, the mode of consumption, frequency of use, elapsed time, and test sensitivity.

Prevention advice: do not drive after consuming a product that may contain THC, even if it is sold as CBD. A negative self-test is neither a legal authorization nor a guarantee of fitness to drive.

What to do in case of a positive test?

The procedure includes a confirmation analysis. At the time of the saliva sample, the driver must be informed of the possibility to request a blood sample in order to reserve the right to a counter-expertise and, if necessary, to the search for medications.
